General sales conditions
The company DMPV (hereinafter referred to as "DMPV"), a single-member limited liability company with a share capital of $9,000, registered with the Brickell, Miami business register under number L2300012345, located at 1200 Brickell Avenue, Suite 800, Miami, FL 33131, engages in the business of providing online coaching services in financial analysis to individuals.

Article 1 – Scope of Application - These General Terms and Conditions of Sale (hereinafter GTCS) govern all sales of services (hereinafter referred to as the "Service(s)") provided by DMPV to any individual or legal entity (hereinafter referred to as "Client") who has placed an order on the website www.frenchtrader.net (hereinafter referred to as the "Site"). The Client's validation of the order constitutes unconditional acceptance of these GTCS, which the Client declares to have previously read. These GTCS represent the sole agreement between the Parties and exclude any other document, except for any specific conditions agreed upon between the Parties. DMPV reserves the right to modify these GTCS. These changes are binding on Clients from the time they are posted online and do not apply to Services contracted before that date.

Article 2 – Services – DMPV will make every effort to provide the Services. These Services aim to help Clients improve their personal financial analysis skills. They are described in French on the www.frenchtrader.net website, specifying their duration, essential features, and price. DMPV is free to use the educational methods and tools of its choice, which the Client accepts. The Client is informed that they may need to create a Client account with a service provider and/or download applications to benefit from the Service, such as an application enabling video conferencing or information sharing.
Any Service subscribed to in the form of a subscription is concluded for a non-renewable one-month period. It should be noted that DMPV does not provide any personalized or non-personalized financial investment advice at any given time. As a result, the Client cannot expect investment advice from the Services, and DMPV cannot be held liable for this in any way. The Client remains entirely responsible for the investments they choose to make or not make, and DMPV cannot be held liable in any way for the investments made by the Client. DMPV does not issue any diplomas or certificates and does not guarantee any level of education after the completion of the Service.

Article 3 – Prerequisites – In any case, to benefit from the Services, the Client must have a computer, tablet, or smartphone with at least Internet access and the ability to receive and read multimedia files. Access equipment and Internet connection fees are the sole responsibility of the Client. The Client must ensure beforehand and during the provision of the Service that their technical environment is continuously compatible with the tools used by DMPV and the content it provides. DMPV specifies on its Site if the Service requires specific transfer tools or software and the methods of accessing or receiving content (download, streaming, access code), as well as any specific prerequisites necessary for the Client to view them. As such, the Client cannot claim incompatibility or lack of access. The minimum technical prerequisites for all services are:
Operating system: Windows, Mac, Linux - Browser: Chrome, Internet Explorer, Firefox.
The Client is responsible for taking all measures to protect their computer system, data, and software, particularly against viruses, cyberattacks, and hacking on the Internet, and for making regular backups.
The Site also specifies the level of understanding, skills, or specific knowledge required for the Client to fully benefit from the Service. However, the Client remains solely responsible for choosing the Service ordered.

Article 4 – Order – To benefit from DMPV's Services, the Client must visit the www.frenchtrader.net website. They fill out a form providing their identity, email address, and the required contact details. They then select the Service they wish to benefit from. Before finalizing the order, the Client has the opportunity to review its details. By confirming the order, they accept the Service and commit to paying DMPV. The Client will then receive an acknowledgment of receipt, summarizing the details of their order by email. The Service will only be provided to the Client after DMPV has received full payment for the chosen Service. Once the order is placed, it is final and cannot be canceled, refunded, or subject to a withdrawal right, in accordance with Article 7 of these GTCS. DMPV may refuse any Service order, particularly if a training or group coaching session is full or, more generally, if human, material, or technical conditions prevent it from providing the Service.

Article 5 – Prices – The prices of the Services are expressed in euros, excluding tax (HT) and including all taxes (TTC), on the website. They may be changed by DMPV at any time without notice. Services and Products are provided at the rate in effect at the time DMPV records the order. Prices are firm and non-negotiable by the Client. The invoice is sent to the Client's email address after their order is confirmed.

Article 6 – Payment Terms – The price is payable online, in full, on the day the Client places the order, through a secure payment method. Payment is made online using the secure payment gateways PayPal or Stripe. DMPV does not store Clients' bank details. For more information on this matter, please refer to DMPV's privacy policy. Payments are processed by PayPal and Stripe. The Client declares that they are authorized to use the bank card, Stripe, or PayPal account used for payment and that the account has sufficient funds to cover the purchases made.
The Client guarantees they have the necessary authorizations to use the chosen payment method. DMPV reserves the right to suspend or cancel any order execution in the event of non-payment or partial payment by the Client, particularly in the event of a payment incident, fraud, or attempted fraud related to the use of the www.frenchtrader.net website or the payment of an order.

Article 7 – Waiver of the Right of Withdrawal – Subscribing to a Service remotely generally gives the Client a right of withdrawal, allowing them to cancel their purchase within 14 days of confirming their order. However, in accordance with Article L.221-28 § 1° and § 13° of the Consumer Code, given the Services provided by DMPV, namely coaching services that include the provision or access to immediately usable digital content, the Client acknowledges that once the digital product is sent, it cannot be refunded. The Service begins before the 14-day withdrawal period expires, with the Client's consent and after an express waiver of their right of withdrawal. Therefore, the order is firm and final, and the Client cannot exercise their right of withdrawal.

Article 8 – Guarantees – DMPV strives to provide the Service in accordance with the Client's order and undertakes to comply with legal obligations of conformity (Articles L.217-4 to L.217-13 of the Consumer Code) and guarantees against hidden defects (Articles 1641 to 1648 of the Civil Code). It is reminded that the Client may decide to implement the guarantee against hidden defects and, if applicable, choose between the termination of the sale or a reduction in the sale price. The action resulting from the hidden defects must be brought by the Client within two (2) years of discovering the defect. In the event of a refund, it will be credited to the Client's bank account.
DMPV does not guarantee that access to the Site will be uninterrupted, error-free, or without slowdown, and provides the Service as available. When the Service includes the provision of digital content, DMPV guarantees that it is usable, i.e., readable and enabling access to the informational content according to the terms and prerequisites specified in these GTCS and on the website. No refund will be given for malfunctions due to the Client's computer configuration, accidental deletion of downloaded files, or the Client's refusal to use recommended software tools.

Article 9 – Liability - DMPV is bound by an obligation of means under these terms. It is expressly understood that DMPV cannot be held responsible in any way for any damage suffered by the Client and/or any third party in the event of:

Any unavailability of the Site, particularly preventing an order from being placed, and more generally, any technical malfunction, network congestion, or failure of Internet service providers.
The Client's fault, negligence, omission, or failure, improper use of equipment or software, improper use of information transmitted during coaching, non-compliance with prerequisites, an insufficient level of understanding, skills, or prior knowledge of the Client, the application of any techniques, exercises, or financial analysis methods transmitted during the Service, or any other information that led to damage, particularly financial or material, for the Client.
Force majeure, events, or incidents beyond DMPV's control.
The fault, negligence, or omission of a third party.
Special, indirect, or more generally, any damage inherent in operating losses, financial losses, loss of profits, deprivation of a right or property, deprivation of a service, and more generally, any economic loss that may result from the provision of the Service.
In any case, DMPV's liability is limited to refunding the Services actually paid for by the Client. In the case of a subscription, compensation cannot exceed the cost of the Service actually paid for by the Client over the last six (6) months.
DMPV declares that it holds insurance covering the consequences of its professional civil liability that may arise from the performance of these GTCS.

Article 10 – Personal Data
As part of this contract, DMPV processes the personal data of its Clients as the data controller in order to provide the Services. All information regarding the processing carried out, including the purposes of processing, the data collected, the potential recipients of the data, any transfers of data outside the European Union, and the retention period of the data, are indicated in DMPV's Privacy Policy. This policy is accessible before any order validation as well as on the Website. Any Client is informed that they have the rights of access, information, rectification, erasure (right to be forgotten), and portability of their personal data. Data portability may be subject to fees charged to the user or Client, who will be informed in advance. They also have the right to object to or limit one or more of the above-mentioned processing activities. Finally, the Client can file a complaint with the CNIL after making a prior request to DMPV.
As part of the Service, each Client is free to participate or not in discussion groups and remains fully responsible for the personal data they share with other Clients or disclose on the application used. The Client also commits to respecting and protecting the personal data of other Clients that they may have accessed during the Service and agrees not to store, disclose, communicate, transmit, either orally or in writing, privately or publicly, without the authorization of the concerned individual, any personal data other than their own. DMPV cannot be held responsible for the disclosure of a Client’s personal data by another Client.

Article 11 – Intellectual Property
DMPV holds all intellectual property rights on its Website. The materials provided by DMPV as part of the Service and accessible on the Website are protected by intellectual property rights, including trademarks, logos, designs, identification signs, catalogs, texts, comments, works, illustrations, still or animated images, plans, specifications, exercises, multimedia content, and, more generally, any informational support. Any total or partial reproduction or representation of the Website, its content, and any of the aforementioned elements is strictly prohibited, potentially constituting an offense of counterfeiting and leading to legal action. The aforementioned elements are also the result of investment and intellectual efforts, reflecting DMPV's knowledge, reflection, expertise, know-how, and developed skills. Therefore, the Client is duly informed that their resale, publication, disclosure, exchange, rental, sharing, or transfer to a third party is strictly prohibited.

Article 12 – Waiver – Validity
The fact that DMPV does not assert, at any given time, one of the clauses of these terms of sale does not constitute a waiver of the right to assert it later. If one of the provisions is declared null by a competent authority, this will not affect the validity and compliance of the other provisions of these General Terms and Conditions of Sale (GTC).

Article 13 – Disputes
In the event of a dispute, the Client must first contact the Company to seek an amicable solution. If difficulties arise in the execution of the contract, the consumer Client also has the option, before taking legal action, to resort to a consumer mediator.
